1. Acceptance of Terms
By accessing or using TryoutDay (“the Service”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all users, including tryout administrators, evaluators, selectors, volunteers, and guest users.
2. Description of Service
TryoutDay is a software-as-a-service (SaaS) platform that enables soccer clubs and organizations to manage player tryouts, including player registration, check-in, evaluation, and team selection. The Service is provided on an “as is” and “as available” basis.
3. User Accounts and Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Provide accurate and complete information when creating an account
- Keep your login credentials secure and not share them with unauthorized parties
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activity conducted through your account
Guest users accessing the Service via event codes are subject to the same Terms. The tryout administrator who generates guest access links is responsible for ensuring appropriate distribution of those credentials.
4. Data Ownership and Rights
Your Data. You retain all ownership rights to the data you submit to the Service, including player information, evaluation scores, roster data, and any other content you create or upload (“Your Data”). We do not claim ownership of Your Data.
License to Operate. By using the Service, you grant TryoutDay a limited, non-exclusive license to store, process, and display Your Data solely for the purpose of providing and improving the Service. This license terminates when you delete Your Data or close your account.
Data Portability. You may export Your Data at any time using the available export features within the Service.
Aggregated Data. We may use anonymized, aggregated data that does not identify any individual for purposes of analytics, service improvement, and reporting. This aggregated data cannot be reverse-engineered to identify specific users or players.
5. Privacy and Data Protection
We take the privacy and security of personal data seriously. The Service may collect and process personal information including player names, dates of birth, contact information, and performance evaluations. You represent and warrant that you have obtained all necessary consents to submit personal data of players and other individuals to the Service, particularly for minors where parental or guardian consent may be required.
We implement industry-standard security measures to protect Your Data, including encryption in transit and at rest, role-based access controls, and secure authentication. However, no method of electronic storage or transmission is 100% secure, and we cannot guarantee absolute security.
6. Liability Waiver and Limitation of Liability
No Guarantee of Results. TryoutDay is a tool to facilitate tryout management. We make no representations or warranties regarding tryout outcomes, player selection decisions, or the suitability of any player for any team. All roster and selection decisions are made solely by the users of the Service.
Limitation of Liability. To the maximum extent permitted by applicable law, TryoutDay and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with:
- Your use of or inability to use the Service
- Any decisions made based on information provided through the Service
- Unauthorized access to or alteration of your data
- Any third-party conduct or content on the Service
- Any interruption or cessation of the Service
Maximum Liability. In no event shall TryoutDay's total aggregate liability exceed the amount you paid for the Service during the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.
Assumption of Risk. You acknowledge that sports tryouts involve inherent risks of physical injury. TryoutDay bears no responsibility for any physical injuries, accidents, or health-related incidents that occur during tryout events managed through the Service.
7. Indemnification
You agree to indemnify, defend, and hold harmless TryoutDay and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
8. Service Availability and Modifications
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We reserve the right to:
- Modify, suspend, or discontinue any part of the Service at any time with reasonable notice
- Perform scheduled and unscheduled maintenance that may temporarily affect availability
- Update features, functionality, and the user interface without prior notice
- Set storage limits, usage quotas, or other operational constraints
9. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws, regulations, or third-party rights
- Submit false, misleading, or fraudulent information
- Attempt to gain unauthorized access to other accounts or systems
- Interfere with or disrupt the integrity or performance of the Service
- Use automated means to scrape, collect, or harvest data from the Service
- Use the Service for any purpose other than managing sports tryouts and related activities
10. Account Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms, with or without notice. Upon termination, your right to access the Service ceases immediately. We may retain Your Data for a reasonable period following termination to comply with legal obligations, after which it will be deleted.
You may terminate your account at any time by contacting us. Upon your request, we will delete Your Data in accordance with our data retention practices, except where retention is required by law.
11. Intellectual Property
The Service, including its design, features, code, and documentation, is the intellectual property of TryoutDay and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without prior written consent.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TryoutDay operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.
14. Changes to Terms
We reserve the right to update these Terms at any time. Material changes will be communicated via the Service or email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
